Plan for Accelerated Claims Resolution Process in Chapter 11

To avoid years of time consuming and expensive litigation, the Archdiocese of Portland, as part of the Chapter 11 proceedings, has submitted a proposal for an Accelerated Claims Resolution Process (ACRP). Archbishop John G. Vlazny has stated he is committed to “just compensation” to those sexually abused by Archdiocesan personnel. The proposed mediation process is modeled on the two successful mediations in which the Archdiocese participated in the years 2000 and 2003. In those mediations approximately 100 claims were resolved.

The proposed plan includes mandatory mediation and a process for binding arbitration for claims that cannot be settled by mediation. The plan proposes streamlined procedures to promote cost reduction and prompt processing of the claims, so that the limited resources of the Archdiocese of Portland can be used to pay valid claims, rather than pay attorneys and other consultants. The proposed Accelerated Claims Resolution Process provides substantial cost savings, efficiencies and tremendous time-saving aspects in resolving claims.

The Archdiocese of Portland believes that this proposed plan for mediation will enable the equitable and just settlement of the tort claims in a timely manner. Archbishop John G. Vlazny hopes that the resolution of these claims will begin the healing process for those involved.
